AfriBusiness is exploring legal options to obtain an interdict against Black First Land First (BLF), Andile Mngxitama (the movement’s leader), and Lindsay Maasdorp (its national spokesperson) for calling upon its supporters and the public to illegally occupy vacant land.

Over the past few months, the business rights watchdog has monitored news reports on various media platforms. It believes that it has enough evidence to continue with appropriate legal action to silence these incitements to violence and to occupy land.

“We cannot sit back and let these comments and calls to action be overlooked. As we have done with Julius Malema and the EFF, we will approach a court of law for a similar interdict against Andile Mngxitama, Lindsay Maasdorp and the BLF. Mngxitama and Maasdorp should be held personally responsible for inciting people to commit such crimes,” says Armand Greyling, Law and Policy Analyst at AfriBusiness.

The BLF has recently also come under fire for inciting the public and its supporters to hold protest action and intimidate journalists who according to the BLF promote so-called “white monopoly capital”. It is clear that the BLF is not an organisation founded on the principles of democracy, but rather on violence and intimidation with no regard or respect for the constitutional rights of other people.

“The BLF’s actions amount to nothing more than criminal acts and should be dealt with accordingly. The group is not even a registered organisation, political party or company, and is rather a malicious racist group. Their views and opinions amount to the incitement of hate crimes against a minority group in South Africa. Everyone has the right to protest and have an opinion as long as it does not infringe on the constitutional rights of others,” says Charles Castle, Manager of the Labour Law Advice Unit at AfriBusiness.
