About this case
Sakeliga has been approached by international stakeholders in the aviation industry regarding the insistence of the International Air Services Council (a local regulator) on B-BBEE (Broad-Based Black Economic Empowerment) certificates and plans. Foreign airlines are seemingly being required to commit to B-BBEE in a manner that appears to be unlawful. The licensing council is demanding that foreign airlines cede ownership to B-BBEE partners and is threatening that, without compliance, the airlines will not be eligible for licenses to operate domestically. Sakeliga is working with representatives from various airlines who hope that Sakeliga will litigate to stop the Council's unlawful insistence on B-BBEE compliance.
