On June 29, 2018, Eskom gave notice that they would cut off the electricity supply to residents of Musina due to the municipality's growing indebtedness to Eskom. This action would have meant that even paying end-users would suffer damage as a result of the payment dispute between Eskom and the municipality. Sakeliga brought an urgent court application to prevent Eskom from proceeding with the complete termination of electricity supply to the municipality. Subsequently, Eskom decided to abandon their plans. This victory played a significant role in preventing Eskom from holding paying end-users hostage to coerce non-paying municipalities to settle their debts. Paying end-users should not be burdened with the consequences of inadequate intergovernmental dispute resolution. • The outcome set the stage for Sakeliga's submissions in the Resilient case. • The power supply to 150,000 businesses was maintained, saving the businesses in the region an estimated R150 million in production losses and lost sales.
